The above entities may be referred to individually or collectively in this Disclaimer as “Excellentiam”, “we”, “us” or “our”, as the context requires.
Excellentiam provides healthcare tourism facilitation, healthcare information, coordination and related non-clinical support, and also provides/facilitates eldercare services within India, subject to the scope of services agreed with the relevant patient, elder, family member, next of kin, authorised representative or client.
Excellentiam's role is primarily that of a facilitator, information provider, coordinator and service-support organisation.
In connection with healthcare tourism, Excellentiam may provide information about healthcare providers, hospitals, doctors, specialists, diagnostic facilities, treatment options and related services and may facilitate communication, appointments, documentation, travel-related coordination or other non-clinical support as agreed.
Our purpose is to assist patients and/or their family members or next of kin in understanding available options and making informed and considered healthcare decisions.
Excellentiam does not make the final medical decision on behalf of the patient or the patient's next of kin.
Unless expressly stated otherwise in a separate written agreement, Excellentiam is not a hospital, clinic, nursing home, diagnostic laboratory, medical practitioner, treating doctor, surgeon, pharmacist, medical emergency service provider or clinical establishment providing diagnosis or treatment.
Excellentiam does not itself diagnose medical conditions, prescribe medicines, perform surgery, determine medical treatment protocols or provide clinical treatment merely by providing healthcare tourism facilitation or information services.
The actual diagnosis, treatment and clinical care are the responsibility of the patient's chosen treating doctor and healthcare institution.
Information, suggestions, explanations or comparisons provided by Excellentiam are intended to help patients and families understand available healthcare options.
Such information must not be interpreted as a diagnosis, prescription, medical opinion or substitute for consultation with a qualified medical professional.
Where medical advice is required, the patient should consult the relevant qualified doctor or healthcare professional directly.
Excellentiam encourages patients and their next of kin to ask appropriate questions, understand the proposed treatment, risks, alternatives, expected costs and likely outcomes, and, where appropriate, obtain an independent medical opinion before making a significant medical decision.
The final decision regarding selection of a hospital, selection of a doctor or specialist, acceptance or rejection of a diagnosis, selection of treatment, surgery or medical procedure, medication, continuation or discontinuation of treatment, and any other clinical decision rests with the patient and/or the patient's legally authorised representative, after appropriate consultation with the treating medical professional.
Excellentiam may provide information and facilitate access to available options, but does not make the clinical decision for the patient.
Hospitals, doctors, specialists, diagnostic centres, laboratories, nursing facilities, pharmacies, rehabilitation providers, ambulance providers and other healthcare professionals or institutions introduced, suggested, referred or facilitated by Excellentiam are generally independent third-party service providers.
Such healthcare providers are responsible for their own professional and clinical services, including diagnosis, medical assessment, treatment planning, surgery and procedures, prescriptions, medication, anaesthesia, nursing and clinical care, investigations, interpretation of medical results, emergency treatment, post-operative care, rehabilitation, management of complications, clinical decisions and medical outcomes.
Excellentiam does not control the clinical judgment or treatment decisions of an independent healthcare provider.
Healthcare and medical treatment involve inherent risks, uncertainties and individual variations.
Excellentiam does not guarantee any particular medical outcome, including cure, recovery, improvement, survival, treatment success, complication-free treatment, treatment response, duration of treatment or prognosis.
Any information relating to treatment success, hospital facilities, doctor experience, technology, accreditation, procedures, outcomes or other healthcare information is provided for informational and facilitation purposes and should be independently verified with the relevant healthcare provider.
Past results or reported success rates do not guarantee future results.
Medical treatment may involve complications, adverse reactions, side effects, unforeseen developments, treatment failure, deterioration of health, injury or other risks.
To the extent permitted by applicable law, Excellentiam is not responsible for the clinical acts, omissions, negligence, malpractice, treatment decisions, complications or medical outcomes attributable to an independent treating healthcare provider.
Nothing in this Disclaimer shall exclude or restrict any liability that cannot lawfully be excluded or restricted under applicable law.
Excellentiam is not an emergency medical service provider.
If a patient experiences a medical emergency, sudden deterioration, serious complication or other urgent medical condition, the patient or family/next of kin must immediately contact the treating hospital, treating doctor, nearest emergency medical facility, ambulance service or appropriate emergency medical service.
Excellentiam's website, telephone numbers, email addresses, WhatsApp or other communication channels should not be relied upon for emergency medical assistance.
Patients and/or their family members or next of kin are responsible for providing complete and accurate information to the relevant healthcare provider.
This may include previous medical history, existing medical conditions, allergies, medicines, previous surgeries, diagnostic reports, ongoing treatments, relevant family history and other information requested by the treating healthcare provider.
Excellentiam may facilitate the transmission of information where authorised, but the patient and/or authorised representative remains responsible for the accuracy and completeness of information supplied by them.
Where appropriate, Excellentiam may suggest or present one or more hospitals, doctors, specialists or healthcare options based on information available to us and the requirements communicated by the patient or family.
Such suggestions are intended to assist the patient in considering available options.
A suggestion or introduction by Excellentiam does not constitute a guarantee of suitability, treatment quality, outcome, medical prescription, certification of the healthcare provider or guarantee that a particular treatment is the best or only treatment available.
The patient and/or authorised representative should independently evaluate the options and take appropriate professional medical advice.
Any treatment cost, package price, quotation, estimate, hospital charge, doctor's fee, medicine cost, diagnostic charge or other financial information communicated by Excellentiam may be based on information supplied by a third party and may change.
Actual costs may vary depending upon the patient's medical condition, investigations, treatment requirements, duration of hospitalisation, medicines and consumables, complications, additional procedures, changes in treatment and other circumstances determined by the healthcare provider.
Unless expressly confirmed in writing by the relevant service provider, Excellentiam does not guarantee that any estimate will be the final amount payable.
Healthcare tourism may involve third-party services such as hospitals, doctors, diagnostic centres, pharmacies, ambulance services, transportation providers, hotels, accommodation providers, airlines or travel providers, visa-related service providers and other independent service providers.
Where such services are provided by third parties, those providers remain responsible for their respective services, terms, charges, availability and performance.
Excellentiam does not control the operations of independent third-party providers.
Excellentiam also provides and/or facilitates eldercare services within India.
Eldercare services may include, depending on the particular engagement: elder support and assistance; caregiver/attendant coordination; companionship; hospital-related support; home-care coordination; assistance with daily activities; coordination with healthcare providers; appointment coordination; family communication/support; care-related facilitation; and other services specifically agreed with the client.
The exact nature and scope of eldercare services shall depend upon the applicable service agreement or engagement with the elder, family member, next of kin, authorised representative or client.
Eldercare services offered by Excellentiam under this section are restricted to India.
Eldercare support and facilitation should not be understood as a substitute for medical diagnosis, medical treatment or emergency medical care.
Where an elder requires medical assessment or treatment, the elder and/or authorised family member should seek assistance from an appropriately qualified medical professional or healthcare institution.
Excellentiam may assist in coordinating access to healthcare services where such assistance forms part of the agreed service.
However, medical decisions remain with the elder/patient, authorised representative and treating healthcare professional, as applicable.
Eldercare may involve circumstances and risks associated with age, mobility, falls, illness, medication, cognitive impairment, frailty, emergencies and other individual conditions.
While Excellentiam will endeavour to provide the agreed services with reasonable care and diligence, no guarantee is given that an elder will remain free from illness, injury, falls, hospitalisation, medical complications or other unforeseen events.
Excellentiam does not guarantee any particular health, recovery, mobility, functional or wellbeing outcome.
Where eldercare involves independent caregivers, attendants, nurses, physiotherapists, doctors, hospitals, diagnostic providers, ambulance services or other professionals, the professional or clinical services provided by such persons or organisations remain subject to their respective professional responsibilities and applicable laws.
The specific responsibility of Excellentiam shall depend upon the services expressly agreed and undertaken by the relevant Excellentiam entity.
The elder, patient and/or authorised family member or next of kin is responsible for providing accurate information, communicating relevant medical and personal requirements, reviewing available options, obtaining appropriate professional advice, understanding the proposed treatment or care arrangements, providing necessary consent and authorisation, and making decisions regarding medical treatment and care.
Where a family member or next of kin acts on behalf of an elder or patient, that person represents that they have the appropriate authority to do so.
The information published on www.excellentiam.org is provided for general information, educational, healthcare facilitation and service-related purposes.
Information may be obtained from healthcare institutions, doctors and healthcare professionals, publicly available sources, third-party websites, service providers, published materials and other sources available to Excellentiam.
Although we endeavour to maintain useful and reasonably accurate information, we do not warrant that all information will always be complete, accurate, current, error-free or continuously updated.
Healthcare facilities, doctors, prices, services, availability, treatment options and other information may change without notice.
Users should verify material information directly with the relevant service provider before making a decision.

Patients and clients should provide information only for legitimate purposes and should ensure that information supplied to Excellentiam is accurate to the best of their knowledge.
Where consent or authorisation is required for the collection, use or sharing of information, the relevant consent/authorisation shall be obtained in accordance with applicable law.
Nothing in this Disclaimer is intended to exclude liability that cannot legally be excluded, restrict rights that cannot legally be restricted, waive statutory rights available to a consumer, or permit any conduct that is prohibited under applicable law.
Any limitation, exclusion or allocation of responsibility contained in this Disclaimer shall operate only to the extent legally permissible.
To the maximum extent permitted by applicable law, Excellentiam shall not be responsible for loss, injury, damage, expense, delay, treatment failure, medical complication, adverse medical outcome or other consequence arising primarily from clinical treatment provided by an independent healthcare provider; clinical decisions made by a treating doctor; acts or omissions of an independent hospital or healthcare provider; negligence or malpractice of an independent healthcare provider; the patient's underlying medical condition; unexpected medical complications; information supplied by third parties; changes in treatment or treatment requirements determined by the treating doctor; changes in third-party pricing or availability; third-party travel, accommodation or transportation services; or decisions independently made by the patient, elder, family member, next of kin or authorised representative.
This provision does not exclude any liability that applicable law does not permit Excellentiam to exclude.
Nothing in this Disclaimer should be interpreted as stating that Excellentiam has no responsibility whatsoever for services that Excellentiam itself has expressly agreed to provide.
Excellentiam remains responsible for performing its own expressly agreed services in accordance with the applicable service agreement and applicable law.
Where there is a separate written agreement, service agreement, registration form, consent form, quotation, invoice or terms and conditions between the client and the relevant Excellentiam entity, the specific terms of that agreement shall also apply.
Before using paid or specifically contracted services, the patient, elder, family member, next of kin or authorised representative may be required to complete and sign the relevant registration form, service agreement, consent form, terms and conditions, acknowledgement, quotation or invoice, and/or other applicable documentation.
Such documents may contain additional terms applicable to the particular service.
In the event of any inconsistency, the applicable written agreement shall govern to the extent permitted by law.
If a patient or family member has a complaint concerning diagnosis, treatment, surgery, medical negligence, hospital care, nursing care, medicines or other clinical services provided by a third-party healthcare provider, the complaint should ordinarily be raised directly with the relevant healthcare provider and, where appropriate, with the competent authority or forum having jurisdiction.
Excellentiam may, where appropriate and within the scope of its role, assist in facilitating communication between the patient/family and the relevant healthcare provider.
Such assistance does not make Excellentiam the treating healthcare provider.
Excellentiam reserves the right to modify, update or revise this Disclaimer from time to time.
The latest version published on www.excellentiam.org shall supersede earlier versions, subject to applicable law and any contractual rights already accrued.
Users are encouraged to review this page periodically.
This Disclaimer shall be governed by and interpreted in accordance with the laws of India, subject to applicable statutory rights and mandatory legal provisions.
Any dispute shall be subject to the jurisdiction of the competent courts/forum having jurisdiction under applicable Indian law, subject to any valid dispute-resolution provision contained in an applicable written agreement.
By using the Excellentiam website or requesting or accepting the relevant services, the patient, elder, family member, next of kin, authorised representative or client acknowledges and understands that:

WE PROVIDE INFORMATION AND SUGGESTIONS TO HELP PATIENTS, ELDERS, FAMILIES AND NEXT OF KIN CONSIDER AVAILABLE OPTIONS AND MAKE INFORMED DECISIONS. THE FINAL MEDICAL DECISION REMAINS WITH THE PATIENT AND/OR AUTHORISED REPRESENTATIVE IN CONSULTATION WITH THE TREATING MEDICAL PROFESSIONAL.
FOR ELDERCARE SERVICES, EXCELLENTIAM PROVIDES/FACILITATES SERVICES WITHIN INDIA SUBJECT TO THE SPECIFIC SCOPE OF SERVICE AGREED WITH THE CLIENT.
NOTHING IN THIS DISCLAIMER IS INTENDED TO EXCLUDE OR RESTRICT ANY LIABILITY OR STATUTORY RIGHT THAT CANNOT LAWFULLY BE EXCLUDED OR RESTRICTED UNDER APPLICABLE LAW.
